A new report published on Wednesday by the American Immigration Council highlighted concerns surrounding the Trump administration’s immigration agenda and its potential threat to democracy. The report underscores why many of the White House’s policies are a continuation of policies under the Biden administration, which followed a larger overall policy trend. Trump, however, has implemented a much more abusive enforcement-only approach.
The report emphasized how the Trump administration’s primary focus is on conducting mass deportations on a broad scale, with increased arrests of noncitizens who are not typically considered safety threats. The report also touches on the deployment of the military and redirecting thousands of federal agents from various agencies to target migrants who may or may not have criminal records, even rounding up citizens on many occasions.
“These policies are a flagrant attack on immigrants and our values as Americans,” said Beth Werlin, Executive Director of the American Immigration Council via a statement. “Our laws dictate that everyone receives a just and fair process, whether they have been in this country for decades or are arriving today in search of safety and protection. We will not tolerate Trump’s ill-conceived policies that sideline due process,” Werlin continued. “We will continue to defend the rights of immigrants and are prepared to challenge unlawful and abusive tactics in the courts. We will shine a light on the misuse of power and hold the government accountable.”
In covering the militarization of immigration enforcement, the report also discussed the attacks on due process through the increased use of local law enforcement for immigration enforcement through programs like 287(g) alongside threats to cut funding for “sanctuary” jurisdictions. The council also mentions efforts to silence dissent by targeting individuals who criticize the administration’s policies, while the sudden and massive influx of migrants is creating inhumane conditions in detention centers that were already inadequate.
The council also highlights the Trump administration’s agenda targeting families and children, from attempts to end birthright citizenship and prevent noncitizen children from attending public schools to restarting family separation policies. This was recently highlighted by the separation of Venezuelan children from their parents for more than a month by the Department of Homeland Security (DHS,) which deported them separately.
“Our nation needs a practical and efficient immigration policy that honors immigrants’ contributions, fuels our economy, protects families, and benefits all Americans,” said Werlin. “The President’s call to invest in immigrant detention, aggressive deportation strategies, and an unnecessary, expensive border wall is not practical, efficient, or consistent with our values,” Werlin continued. “It sends a signal that America is closed for business and that our doors are shut to those in need.”
The report also analyzes the White House’s efforts to restrict legal immigration by limiting various avenues for legal migration and asylum, or eliminating them. This is being done through expanded expedited removals, or “fast-track deportations.” This resulted in devious policies like issuing Notices to Appear (NTA) in immigration court, only to have cases dropped (removing protections offered by a pending case) and immediately taking migrants into custody and deporting them. But not before passing through a detention center.
It’s an issue Human Rights Watch argued is unnecessarily cruel, as conditions are increasingly deteriorating every day in detention centers due to massive overcrowding. No fewer than 13 people have died in Immigration and Customs Enforcement (ICE) detention centers this year alone. The U.S. is currently on track to have one of its deadliest years for migrants.
“We at the American Immigration Council believe in an America that honors our diversity and ingenuity and celebrates the fact that we are, and always will be, a nation of immigrants. We will carry on the fight for this America,” Werlin concluded.
The council’s report warns that these actions could collectively erode democratic principles, not just by weakening due process and creating a climate of fear in immigrant communities, but also by eroding what little trust people have in law enforcement. Additionally, the council points out that mass deportations and restrictions on legal pathways would have negative economic consequences by hurting specific industries, alongside a decline in tax revenue and GDP.
While the report highlights much of what we know and what we’ve seen, having a deep analysis provides us with data to look back on to continue documenting the United States’ accelerated descent into a fascist police state under Trump. The white Christian nationalism behind it all can not be more evident than the White House’s propaganda campaign that invokes white-centered racist imagery, promoting the idea that the U.S. is a “whites-only” country.
